Terms of service

1. Acceptance and scope

Pilates Pro (“we”, “us”, “the platform”) is an online marketplace that connects clients with independent instructors offering Pilates videos, structured programs, in-person or studio sessions, a community forum (when enabled), marketing newsletter tools (when enabled), and accounting tools (when enabled). By creating an account, browsing the catalog, purchasing content, booking a session, posting on the forum, or otherwise using the platform at https://heuretik.com, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use Pilates Pro. These terms apply to all users (clients, instructors, and visitors), subject to mandatory consumer-protection rules that cannot be waived.

2. Operator and marketplace role

Instructors are independent professionals who publish and fulfil their own offerings. Pilates Pro does not employ instructors and is not a party to the instructional relationship between a client and an instructor, except as intermediary for platform services, payments (when enabled), and related support.

3. Accounts, eligibility and roles

Pilates Pro supports different roles, including clients, instructors, and platform administrators. You must provide accurate registration information, keep your login credentials confidential, and update your details when they change. You are responsible for activity carried out under your account. Notify us promptly at webmaster@heuretik.com or via the Contact page if you suspect unauthorized access. You must be legally capable of entering into a binding contract in your jurisdiction. If you use the platform on behalf of an organization, you represent that you are authorized to bind that organization. We may suspend or terminate accounts that provide false information, violate these terms, or create risk for other users or the platform.

4. Payments, fees and cancellations

Online card payments via WayForPay are not currently enabled on Pilates Pro. Prices may still be shown in the catalog for information; any alternative payment arrangements are confirmed separately by the platform or instructor. Payment processing fees (WayForPay commission, currently estimated at 0% of the amount paid) are not charged to the client. They are borne by the platform. If a paid physical session booking is cancelled and a refund is issued, the WayForPay processing fee/commission is not refunded to the client and may be retained according to the platform configuration, subject to any mandatory consumer rights. For physical sessions, if you cancel more than 24 hours before the scheduled start time, the refund is processed automatically according to the rules above. If you cancel within 24 hours of the scheduled start time, the refund is not automatic and may require manual review by the platform or instructor. Cancelling a physical session is free of cancellation fees when done at least 24 hours before the scheduled start. Joining the waitlist for a full slot does not charge you until a booking is confirmed. When a place opens, waitlisted clients are notified so they can book the slot.

5. Digital content and personal licences

The catalog may include digital products such as individual videos and multi-session programs. Product descriptions, levels, durations, languages, and prices are provided for information and may change before purchase. Access to purchased digital content is personal and intended for your own practice through your account library, subject to any limits shown at purchase. A purchase grants you a limited, personal, non-exclusive, non-transferable licence to access the relevant content for private use. You may not copy for redistribution, publicly screen, resell, sublicense, or commercially exploit marketplace content without written permission from the rights holder. Instructors represent that they have the rights needed to publish the materials they upload and that those materials do not infringe third-party rights.

6. Physical sessions and bookings

Physical sessions depend on instructor availability, venue rules, and successful booking confirmation. Schedules, locations, and prices shown in the catalog or studio pages are informational until booking is confirmed. You are responsible for arriving on time and for assessing whether a session is suitable for your health and fitness level. Venue-specific rules (access, equipment, cancellation at the studio) may also apply and are communicated by the instructor or venue where relevant. Payment, prepayment, waitlist, and cancellation rules for paid bookings are described in the payments section of these terms and reflect the live platform configuration.

7. Intellectual property

Videos, programs, text, images, branding, software, and other materials on Pilates Pro remain the intellectual property of Pilates Pro, the relevant instructor, or their licensors. Nothing in these terms transfers ownership of intellectual property to you, except the limited licence expressly granted for purchased or booked offerings. Feedback you send may be used to improve the platform without obligation to you.

8. Acceptable use

You agree to use Pilates Pro lawfully, respectfully, and in line with these terms. In particular, you must not: • attempt to disrupt, probe, or overload the service; • scrape, harvest, or systematically extract catalog or user data; • share account access in a way that circumvents personal licences; • upload unlawful, harmful, defamatory, or infringing content; • impersonate another person or misrepresent your affiliation; • use the platform to send spam or abusive communications; • post on the forum unlawful, harassing, or defamatory content, sensitive data, or detailed third-party medical information; • circumvent security, payment, marketing consent, or access controls. We may suspend or terminate accounts that violate these rules, without prejudice to other remedies.

9. Health and fitness disclaimer

Pilates and related movement practices involve physical activity. Content and sessions on Pilates Pro are provided for general wellness and educational purposes and are not a substitute for medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting a new exercise program, especially if you are pregnant, recovering from injury, or have a medical condition. You participate in digital and physical sessions at your own risk and should stop any exercise that causes pain or discomfort.

10. Availability, warranties and liability

We aim to keep Pilates Pro available and secure, but we do not guarantee uninterrupted access, error-free operation, or that every instructor listing will remain available indefinitely. To the fullest extent permitted by applicable law, Pilates Pro and its operators are not liable for indirect, incidental, special, or consequential damages arising from use of the marketplace, instructor services, or third-party payment providers. Nothing in these terms limits liability that cannot be limited under mandatory consumer-protection or other mandatory rules (including liability for death or personal injury caused by negligence where such limitation is unlawful).

11. Consumer rights

If you are a consumer, mandatory rights under applicable consumer law remain unaffected. For digital content, specific withdrawal or refund rules may apply depending on your jurisdiction and whether performance began with your prior express consent. For physical sessions, cancellation and refund rules are set out in the payments section and may be supplemented by mandatory local rules. If a mandatory rule conflicts with these terms, the mandatory rule prevails.

12. Governing law and disputes

These terms are governed by Ukrainian Law, without prejudice to mandatory consumer-protection rules of your country of residence that cannot be waived. Subject to those mandatory rules, disputes shall be submitted to the courts of Kyiv City Court. Before formal proceedings, you may contact us at webmaster@heuretik.com so we can try to resolve the matter amicably.

13. Community forum

When the forum is enabled, authorized users may create threads, reply, react, and use categories/tags according to platform configuration. Instructors may moderate content linked to their space when this feature is enabled. Pilates Pro may moderate, hide, or remove content that violates these terms or the law. You retain rights in your content but grant Pilates Pro a limited licence to host, display, and moderate your posts as part of the service. You warrant that you have the necessary rights and do not infringe third-party rights. The forum is not a substitute for medical or professional advice. Community discussions are informational; consult a qualified professional for personal health questions.

14. Marketing newsletter tool

The newsletter module allows Pilates Pro (admin campaigns) and authorized instructors (campaigns to their clients) to send marketing emails. Common obligations: • send only to persons with active consent for the relevant scope (platform or instructor); • do not bypass mandatory opt-in filters or pre-send compliance checks; • do not include sensitive data (GDPR Art. 9) without an appropriate lawful basis — generally prohibited in v1; • include a working unsubscribe link in every marketing email. Admin campaigns: Pilates Pro is data controller vis-à-vis recipients. Use of the admin tool requires acceptance of admin newsletter terms (checkboxes A1–A3). Instructor campaigns: the instructor is data controller and must inform their clients in compliance with the GDPR. Access to the instructor tool requires acceptance of the newsletter liability waiver (checkboxes W1–W3). Pilates Pro acts as technical processor (sending, tracking, unsubscribe). Open and click tracking is described in the Privacy Policy (§ 12). Claims related to an instructor campaign primarily rest with the responsible instructor.

15. Accounting module and exports

Pilates Pro provides a technical tool to generate and transmit accounting exports (transactions, invoices, attachments). This tool is not accounting, tax, or legal advice. Limits: the current module does not replace PRRO fiscalization (Ukraine), fiscal receipt issuance, certified income ledger, VAT/ПДВ registers, structured marketplace acts under Ukrainian platform law 2025+, or certified balance sheet export. Before any first export or send to an accountant, the instructor or administrator must accept the accounting export liability waiver (checkboxes E1–E3 or A1–A3). Acceptance is logged and may be requested again if the document version changes. The instructor remains solely responsible for tax and accounting obligations, document retention (including 5 years), export verification, and secure transfer to a mandated advisor. Full export access may depend on the instructor plan (commercial limitation, not a legal exemption). See the platform accounting help documentation for detailed scope and deferred features.

16. Changes and contact

We may update these terms from time to time to reflect product, legal, or operational changes. The “Last updated” date at the top of this page will be revised accordingly. Continued use of Pilates Pro after changes become effective constitutes acceptance of the updated terms, except where mandatory law requires a different process.
